Terms and Conditions

Welcome to the CIXOR mobile Application. These Terms and Conditions (“Terms”) govern your use of the CIXOR mobile application (“CIXOR”) developed by CIXOR (Pvt) Ltd, which provides Earned Wage Access (EWA) and loan marketplace services. By downloading, installing, or using CIXOR, you agree to be bound by these Terms.

By accessing or using CIXOR, you agree to these Terms. If you do not agree, do not use CIXOR.

1. Definitions

  • CIXOR: The CIXOR mobile application developed and operated by CIXOR (Pvt) Ltd.
  • User / Borrower: An individual who registers on CIXOR to access earned wages and apply for loans.
  • Employer: An organization participating in CIXOR’s EWA system by sharing payroll data.
  • Lender: A verified third-party individual or entity providing loan offers to Users through a separate platform.
  • Loan: A monetary amount offered by a Lender to a Borrower under a separate agreement.
  • Earned Wage Access (EWA): A service enabling Users to withdraw wages they have earned but have not yet been paid.
  • Marketplace Services: Functionality connecting Users with Lenders for borrowing purposes.
  • Services: All features provided via CIXOR, including EWA, loan marketplace, account management, and payment services.

2. Eligibility

To use CIXOR or its related services, the following criteria must be met:

2.1 User / Borrower

  • At least 18 years old.
  • Legally employed by a participating Employer.
  • Reside in a jurisdiction where CIXOR is legally available.
  • Provide accurate personal and employment information.

2.2 Employers

  • Must enter into a formal agreement with CIXOR (Pvt) Ltd.
  • Legally registered and compliant with employment and payroll laws.
  • Provide accurate and timely payroll and time-tracking data.
  • Agree to share relevant employee data for calculating earned wages.

2.3 Lenders

  • Legally registered and authorized to offer loans in their jurisdiction(s).
  • Pass CIXOR verification process.
  • Comply with all applicable laws, including lending, consumer protection, and data privacy.
  • Provide clear, accurate loan terms for each offer.
  • Use the dedicated Lender interface provided by CIXOR.

3. License Terms

3.1 General License Grant

CIXOR (Pvt) Ltd grants a limited, non-exclusive, non-transferable, revocable license to access and use the Services according to these Terms and designated roles.

3.2 Users / Borrowers

Rights:

  • Download, install, and use CIXOR on a personal device for individual use.
  • Access EWA, payment features, and loan marketplace features.

Restrictions:

  • No illegal, deceptive, or fraudulent use.
  • No sharing or sublicensing of the platform.

3.3 Employers

Access to a secure portal or API for:

  • Uploading/integrating payroll and time data.
  • Managing EWA and employer settings.

Restrictions:

  • No reverse-engineering, distribution, or tampering.
  • No sharing credentials with unauthorized parties.
  • Use platform only for workforce financial services.

3.4 Lenders

Access to a dedicated platform to:

  • Manage loan listings, respond to applications, monitor repayments.
  • View borrower data lawfully.

Restrictions:

  • No bypassing verification or off-platform loans via CIXOR leads.
  • No misusing borrower data beyond legal lending purposes.
  • No misrepresentation of loan terms or operating outside licensing jurisdiction.

4. Services Provided

4.1 Users / Borrowers

  • EWA: Withdraw portion of earned wages.
  • Loan Marketplace: Compare and apply for loans from verified Lenders.
  • Payments & Transfers: Repay loans and manage transactions.
  • Notifications & Support: Alerts, confirmations, and assistance.

4.2 Employers

  • Dashboard/API for payroll and EWA management.
  • Financial wellness tools for employees.
  • Reporting and compliance support.
  • Dedicated support services.

4.3 Lenders

  • Lender portal for posting loans, receiving applications, managing repayments.
  • Borrower matching and loan management tools.
  • Support and dispute resolution.

All services are subject to applicable fees and usage limits.

5. Earned Wage Access (EWA)

  • Availability depends on Employer participation and payroll data.
  • Funds are calculated based on reported hours or earnings.
  • Fees and timelines are shown before transaction confirmation.

6. Loan Marketplace

  • Users may receive offers from registered third-party Lenders.
  • Loan terms set solely by the Lender.
  • CIXOR only connects Users and Lenders; not a party to loans.
  • Users are responsible for reviewing loan terms carefully.

7. Responsibilities of Employers

  • Provide accurate payroll data.
  • Maintain platform integration.
  • Comply with labor, tax, and privacy regulations.

8. Responsibilities of Lenders

  • Comply with laws and financial regulations.
  • Disclose loan terms accurately.
  • Handle servicing and collections independently.

9. Risk Disclosure

Participation involves financial, operational, and regulatory risks:

9.1 Borrower Risks

  • Legal obligations from loans; late repayment may incur fees or reporting.
  • Payroll inaccuracies may affect wage availability.
  • Platform interruptions or technical issues are not liable to CIXOR.

9.2 Employer Risks

  • Errors in payroll/time-tracking may cause disputes or dissatisfaction.
  • Compliance with local labor, tax, and notification laws is employer responsibility.
  • Platform interruptions do not make CIXOR liable.

9.3 Lender Risks

  • Lenders assume borrower default risk.
  • CIXOR does not guarantee repayment or assess creditworthiness.
  • Lenders must comply with laws and maintain confidentiality.

10. Obligations

10.1 Borrower Obligations

  • Provide accurate personal/employment data.
  • Use services responsibly.
  • Comply with these Terms and Lender agreements.
  • Repay loans and EWA funds on time.
  • Keep credentials secure and report unauthorized access.

10.2 Employer Obligations

  • Provide accurate payroll/employment data.
  • Obtain necessary consents from employees.
  • Comply with labor, wage, tax, and privacy laws.
  • Maintain secure access to dashboards/APIs.

10.3 Lender Obligations

  • Comply with licensing and financial regulations.
  • Disclose loan terms clearly.
  • Use data solely for lending purposes.
  • Follow platform rules; no off-platform solicitation.

11. Privacy and Data Use

  • Data collected for platform functionality, compliance, and fraud prevention.
  • Borrowers consent to sharing employment/financial data with Employers/Lenders.
  • Accuracy of submitted data is the responsibility of the submitting party.
  • CIXOR implements security measures but does not guarantee 100% protection.
  • Third-party integrations are at the user’s risk.
  • Data retained as required by law; users may request deletion subject to obligations.

12. Intellectual Property

All software, logos, and content are property of CIXOR (Pvt) Ltd or licensors. No reproduction/modification without consent.

13. Disclaimers

  • CIXOR is not a bank, lender, employer, or credit bureau.
  • Does not endorse specific Lenders.
  • Services provided “as is” without warranty.

14. Limitation of Liability

  • No liability for indirect, incidental, or consequential damages.
  • CIXOR not responsible for loans, wage access, or employer/Lender actions.
  • Maximum liability limited to amounts paid directly to CIXOR.

15. Termination

  • CIXOR may suspend or terminate access for violations, misuse, fraud, business closure, or non-compliance.
  • Users may deactivate accounts via support.

16. Changes to These Terms

CIXOR may update these Terms. Continued use indicates acceptance. Users should review periodically.

17. Governing Law

These Terms governed by laws of the Democratic Socialist Republic of Sri Lanka. Disputes under Sri Lankan courts.
